ubrZati ("we," "us," or "our") is committed to protecting the privacy and personal information of our users, including parents, guardians, and athletes who use the ubrZati mobile application and related services (collectively, the "App"). This Privacy Policy describes how we collect, use, disclose, and safeguard information when you access or use the ubrZati App. Please read this policy carefully. If you do not agree with its terms, please do not use the App.

ubrZati is headquartered in Brevard County, Florida, and operates in compliance with applicable federal and state laws, including the Children's Online Privacy Protection Act (COPPA), the Florida Information Protection Act (FIPA), the Family Educational Rights and Privacy Act (FERPA) where applicable, and other relevant privacy regulations.

1. Who This Policy Applies To

This Privacy Policy applies to:

  • Parents and Legal Guardians who create accounts and manage athlete profiles on behalf of minor athletes.
  • Athletes (Age 13 and older) who use the App directly with a verified account.
  • Minor Athletes (Under Age 13) whose information is collected only through a verified parent or guardian account in compliance with COPPA.
  • Coaches, Team Administrators, and Club Officials who access the App to manage athlete data and communications.

2. Information We Collect

2.1 Information You Provide Directly

We collect the following categories of personally identifiable information (PII) provided voluntarily by users or their parent/guardian:

Account Registration:

  • Full name (parent/guardian and athlete)
  • Email address
  • Password (encrypted)
  • Phone number
  • Date of birth (to determine age and applicable privacy protections)
  • Relationship to athlete (e.g., parent, guardian, coach)

Athlete Profile Information:

  • Athlete name and age
  • Sport(s) and event(s) competed in
  • Club, team, or school affiliation
  • Athletic performance data (race times, scores, rankings, personal records)
  • Photo or profile image (optional)
  • Physical attributes relevant to sport performance (e.g., height, weight — optional)

Communications:

  • Messages sent within the App's communication features
  • Notifications and announcements

Payment Information (if applicable):

  • Billing name and address
  • Credit/debit card or payment method information (processed through a PCI-DSS compliant third-party payment processor; we do not store full card numbers)

2.2 Information Collected Automatically

When you use the App, we may automatically collect:

  • Device type, operating system, and unique device identifiers
  • IP address and approximate geographic location (city/state level)
  • App usage data, including pages viewed, features used, and session duration
  • Crash reports and diagnostic data
  • Log files and analytics data

2.3 Information from Third Parties

We may receive information from:

  • Sports governing bodies, meet management platforms, or timing systems that integrate with ubrZati
  • Social login providers (e.g., Google, Apple) if you choose to authenticate via those services
  • Payment processors for transaction confirmations

3. Special Protections for Children Under 13 (COPPA Compliance)

ubrZati takes the privacy of minor athletes very seriously. We comply fully with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506, and the FTC's COPPA Rule (16 C.F.R. Part 312), including the January 2025 FTC updates.

3.1 Parental Consent Required

We do not collect, use, or disclose personal information from children under the age of 13 without verifiable parental consent. The parent or guardian must:

  1. Create an account on behalf of the minor athlete
  2. Provide verifiable consent via our in-app consent process before any data related to the minor is processed
  3. Review and agree to this Privacy Policy on behalf of their child

3.2 What We Collect from Children Under 13

Only the following information is collected for minor athletes, solely through the parent/guardian account:

  • First and last name
  • Age and date of birth
  • Athletic event and performance data
  • Team or club affiliation
  • Profile photo (optional; parent/guardian consent required)

We do not collect sensitive personal information from children under 13 beyond what is necessary to provide the App's athletic management services.

3.3 Parental Rights

Parents and legal guardians have the right to:

  • Review any personal information collected about their child
  • Correct or update information in the athlete profile
  • Request deletion of their child's personal information at any time
  • Refuse further collection or use of their child's information by contacting us
  • Revoke consent at any time, after which we will delete the child's information promptly

3.4 No Behavioral Advertising to Minors

We do not use personal information from users under the age of 18 for behavioral advertising, targeted marketing, or sale to third-party advertisers.

4. Florida Social Media Safety Act Compliance

Effective January 1, 2025, Florida's Social Media Safety Act requires age verification for certain digital platforms. ubrZati implements age verification mechanisms during account registration to ensure appropriate protections are applied to users under the age of 16, and to comply with applicable Florida law.

5. How We Use Your Information

We use the information collected to:

  • Provide and operate the App: Create and manage accounts, display athlete profiles, track performance data, and facilitate team/coach communications.
  • Personalize your experience: Customize dashboards, event recommendations, and performance summaries.
  • Send important notifications: Alerts about meet schedules, performance updates, team messages, and App changes.
  • Improve the App: Analyze usage patterns, diagnose technical issues, and develop new features.
  • Process payments: Facilitate registration fees, subscriptions, or in-app purchases.
  • Ensure safety and compliance: Verify user ages, prevent unauthorized access, and comply with legal obligations.
  • Communicate with you: Respond to support requests, provide App updates, and send service-related announcements.

We do not sell personal information to third parties. We do not use athlete data for purposes unrelated to athletic performance tracking and team management.

6. How We Share Your Information

We may share information in the following limited circumstances:

6.1 With Coaches, Clubs, and Team Administrators

Athlete performance data and profile information may be visible to authorized coaches, team administrators, or club officials within the same team or organization on the App. This sharing is controlled by the parent/guardian account settings.

6.2 With Service Providers

We engage trusted third-party vendors to help operate the App, including:

  • Cloud hosting and data storage providers
  • Payment processing services (PCI-DSS compliant)
  • Analytics platforms (configured to minimize PII collection)
  • Customer support tools

All service providers are contractually bound to use your data only to perform services on our behalf and in accordance with this Privacy Policy.

6.3 With Sports Governing Bodies and Meet Systems

With your permission, athlete performance results may be shared with meet management systems, state or national athletics associations, or ranking platforms (e.g., USATF, FHSAA) for official record-keeping.

6.4 Legal Requirements

We may disclose information if required to do so by law, court order, or governmental authority, or if we believe disclosure is necessary to protect the safety of any person, prevent fraud, or enforce our Terms of Service.

6.5 Business Transfers

In the event of a merger, acquisition, or sale of assets, user information may be transferred as part of that transaction. We will notify users before their data becomes subject to a different privacy policy.

7. Data Retention

We retain personal information for as long as necessary to provide the App's services and comply with legal obligations:

Upon account deletion, personal information is purged from active systems within 30 days and from backup systems within 90 days, except where retention is legally required.

8. Data Security

ubrZati implements industry-standard technical and organizational safeguards to protect your information, including:

  • Encryption: All data transmitted between the App and our servers uses TLS 1.2 or higher encryption. Stored data is encrypted at rest using AES-256.
  • Access controls: Only authorized personnel with a demonstrated need have access to user data. All access is logged and audited.
  • Secure authentication: Password hashing and optional two-factor authentication (2FA) for parent/guardian accounts.
  • Third-party security audits: Regular vulnerability assessments and penetration testing.
  • Incident response plan: In the event of a data breach, we will notify affected users and applicable regulators within the timeframes required by Florida's Information Protection Act (FIPA) and applicable federal law.

Despite these measures, no system is 100% secure. We encourage users to choose strong, unique passwords and to notify us immediately at security@ubrzati.com if they suspect unauthorized access to their account.

9. Your Privacy Rights

9.1 All Users

All users have the right to:

  • Access: Request a copy of the personal information we hold about you.
  • Correction: Request that inaccurate or incomplete information be corrected.
  • Deletion: Request that your personal information be deleted, subject to certain legal exceptions.
  • Portability: Request that your data be provided in a portable, machine-readable format.
  • Opt-out of marketing: Unsubscribe from promotional communications at any time via the "unsubscribe" link in emails or through App notification settings.

9.2 Florida Residents

As a Florida-based company serving Florida users, we comply with the Florida Digital Bill of Rights (effective July 1, 2024) for applicable businesses, and Florida's Information Protection Act (FIPA), Fla. 10. Cookies and Tracking Technologies

The App may use cookies, pixels, and similar tracking technologies to:

  • Maintain user sessions and preferences
  • Analyze App performance and usage trends
  • Detect and prevent fraud

We do not use third-party advertising cookies or behavioral tracking pixels. You may configure your device to limit tracking; however, some App features may be affected.

11. Third-Party Links and Integrations

The App may contain links to third-party websites, meet registration platforms, or social media services. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing any personal information.

12. Push Notifications

With your permission, the App may send push notifications related to meet schedules, performance updates, and team communications. You may opt out of push notifications at any time through your device settings or within the App's notification preferences.

13. Communications Between Coaches and Minor Athletes

In alignment with SafeSport guidelines and best practices for youth athletic programs, all electronic communications between coaches and minor athletes conducted through the App are:

  • Transparent: Visible to the minor's parent or guardian within the App
  • Professional: Limited to athletic, team, and event-related content
  • Logged: Retained for accountability and safety purposes

Parents may request to disable direct messaging between their minor child and any coach or administrator at any time.

14. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our practices, legal requirements, or App features. When we make material changes, we will:

  • Post the updated policy in the App with a revised "Last Updated" date
  • Send a notification to registered users via email or in-app alert
  • For material changes affecting minor athletes, require renewed parental consent where required by law

Your continued use of the App after the effective date of any update constitutes acceptance of the revised policy.

16. Governing Law

This Privacy Policy is governed by the laws of the State of Florida. Any disputes arising under this Policy shall be resolved in the courts of Brevard County, Florida, or the applicable federal court for the Middle District of Florida.
